Roger E. Shumate concentrates his civil litigation practice primarily in the area of employment law, including defense and prosecution of wrongful termination
actions and civil rights cases, in state and federal courts in
Wyoming. He also regularly provides advice to Wyoming clients on how to handle
work-place disputes and comply with federal and state law. He also presents seminars to employers on how to prevent employment-related lawsuits and handle work-place disputes and has
assisted employers in drafting personnel policies and procedures and employee handbooks.
Mr. Shumate also has more than 20 years of experience in the defense of personal injury, property damage, product liability, worker's
compensation, ERISA claims, commercial litigation, asbestos litigation and has defended bad faith actions brought against insurance companies. He
also has experience as board counsel to local and state governing
bodies. He has represented both appellants and appellees before the Wyoming Supreme Court and the United States Court of Appeals for the Tenth Circuit.

Experience:
Following
graduation from the University of Wyoming College of Law and admission
to the Wyoming State Bar in 1985, Mr. Shumate began his practice with
Murane & Bostwick as an associate, becoming a partner in 1990. Since 1990, his
practice has been concentrated in the defense and prosecution of employment claims,
including breach of contract, civil rights, discrimination, workers' compensation and
Fair Labor Standards Act claims. He has also continued representing insureds and
non-insureds in personal injury, premises liability, motor vehicle accident
commercial and work-place injury lawsuits and insurance companies in breach of contract/bad faith claims.
He has represented clients as lead counsel in 30 trials in federal and state courts and as
lead counsel in 12 appeals to the Wyoming Supreme Court and the United States
District Court of Appeals, Tenth Circuit. Mr. Shumate has also represented clients
in administrative proceedings before state and federal administrative agencies,
including the Wyoming Fair Employment Practices Commission, the Wyoming Office
of Administrative Hearings, The Equal Employment Opportunity Commission, the
Wyoming Employment Security Commission and the United States Department of Labor.
Mr. Shumate has served as lead
counsel in litigation involving claims for breach of contract, gender, age, religious,
disability and pregnancy discrimination and sexual harassment representing individuals, small
employers and multi-national corporations. He has also served as lead counsel in employment and
civil rights cases filed against governmental entities in Wyoming, including counties,
hospitals and public employees.
Mr. Shumate has also received specialized training in
employment law and mediation at the Center for Labor and Employment Law at New
York University School of Law and offers his services as a mediator in areas
where he normally practices.
